EU Commission consults on the future of copyright in the digital age
On 29 September 2026, the European Commission launched a targeted consultation on possible changes to the EU copyright framework in response to technological and market developments.
The consultation focuses on four key areas:
(i) the use of copyright-protected content in generative AI,
(ii) online piracy of time-sensitive content such as live events,
(iii) remuneration for the use in the EU of sound recordings of non-EU performers and producers, and
(iv) copyright rules affecting scientific research.
This new consultation follows the Commission’s May 2026 call for evidence on the review of the 2019 DSM Copyright Directive. The Commission is now considering whether further targeted measures are needed and is gathering views on possible policy options. The outcome will feed into the preparation of a potential initiative aimed at creating a better copyright environment for European creativity and innovation.
Why does this matter for businesses? Companies active in the creative industries, AI, media, research and other copyright-intensive sectors now have an opportunity to bring practical concerns and market experience directly into the Commission’s policy-making process. Importantly, respondents may answer only the sections relevant to them and may submit supporting documents alongside their responses.
The consultation is open until 3 November 2026.
